菅直人喺大韓帝國被吞併一百周年,再向大韓民國道歉之餘,並且由宮內廳批准,歸還《朝鮮王室儀軌》呢啲文物,睇落一小步,但查實意義非凡,日本喺民主黨執政下,可以開始向歷史負責嘅漫漫長路。

得到天皇批准道歉,呢點好重要,因為日本唔少右派認為當年侵略係天皇行為,天皇講嘅佢地就要做,佢地做嘅唔駛找數,依家睇日皇訪韓期間有無講話,對日本右翼班硬膠,天皇開金口至可以算數。一如當年如果無玉音放送,你估單憑首相講嘢日軍會唔會投降?但呢著,係表示首相做嘢得到皇室認可。所以今年無閣員夠膽參拜靖國神社,唔只係民主黨政策問題,而係日皇明仁暗示咗佢嘅立場,你身為大臣敢拜?

但另一樣嘢更重要,就係日本用行動承認大韓民國繼承大韓帝國嘅法統。因為今次歸還嘅文物,好似朝鮮皇室儀軌,點解係天皇揸住,因為代表天皇就係朝鮮皇帝,《日韓併合條約》係大韓帝國皇帝送國家俾大日本帝國皇帝,呢個係問題,《日韓基本條約》點簽都好,無清理大韓帝國法統邊個繼承問題,依家如果有關文物送返景福宮,代表日本皇室全面放棄所有自大韓帝國以嚟所有喺朝鮮半島權利,徹底將國家送還大韓帝國嘅繼承者,亦即係大韓民國,喺歐洲標準嚟講,日韓兩國喺國家權利層面就己經各不相欠。剩番係個人迫害果啲賠償問題要清理,呢個日本遲要學德國咁清,但搞掂呢個法統問題,心中少咗條刺,日後傾起賠償會順好多係事實,日本民主黨係有周詳計劃對韓道歉。

如果日本可以一步步學德國咁承擔二次大戰嘅責任,小弟認為中(中華民國)、韓可以考慮支持日本喺南千島群島(北方四島)嘅主權主張。講句衰啲,蘇聯係搏懵嘅,佢有乜資格要喺中國東北果堆日本財產,同埋南千島群島以至庫頁島。

後話:好多皇室同皇室之間嘅條約,條文本身往往留有灰色地帶嘅話,又無其他行動配合,成件事可以好膠。好似《中英聯合聲明》同中英主權移交儀式,因為英女皇無話主動放棄喺香港同九龍半島嘅割讓主權,議會唔可以代皇室宣稱放棄某個宣稱(所以呢次日皇歸還韓國皇室遺物,《日韓併合條約》至叫徹底終結),連Hong Kong Act 1985都話不再有,不是主動放棄,加上中華人民共和國可唔可以繼承大清帝國法統都好成疑問,因為大清帝國法統係中華民國繼承,所以除非英女皇與中華民國再簽協定,徹底清理呢個問題,否則英國有必要時,理論上可以再宣稱擁有界限街以南嘅權利,特別香港係未經公投下出現「治權轉移」。話Hong Kong Act 1985話唔會再俾因香港聯繫出現嘅女皇子民,但呢個法理黑洞有幾黑,小弟都諗緊。

大家睇睇《南京條約》以下條文,就知《中英聯合聲明》膠咗響邊:
三、因大英商船遠路涉洋,往往有損壞須修補者,自應給予沿海一處,以便修船及存守所用物料。今大皇帝準將香港一島給予大英國君主暨嗣後世襲主位者常遠據守主掌,任便立法治理。
皇帝交皇帝,理論上,香港島係Isle of Man同Channel Islands一樣,係英女皇私人財產嚟,《中英聯合聲明》幾有效力,存疑中。

大家諗吓Channel Islands同Isle of Man嘅奇怪架構,以至睇嚟都解決唔到嘅直布羅陀問題(仲要西班牙皇室依家仲存在喎⋯⋯),應該諗到有乜膠事發生緊。

    What I’m worried is that… the handover ceremony was attended by the Queen’s very own representative, the Prince of Wales. Did his attendance mean anything in the context of international law?

    問題係,威爾斯親王以國家元首代表,不是女皇個人,但大清帝國交香港出去,是大清皇帝交予大英國王,這才是出事之處。

    It wasn’t clear. The Prince of Wales (1) represented the Queen, and (2) is the heir to the Queen. We don’t know whether he was acting (a) in the capacity as the representative of the head of state, or (b) in the capacity as the representative of QEII. But then no matter what, as an heir to the throne (i.e. condition (2)) he had indicated his intention to relinquished his jurisdiction over HK before his ascension to the throne. I believe in referendum and I hope you are right, but I’m worried that your argument isn’t perfect enough.

    Yes, I agree with you that the Treaty of Nanking and the Convention of Peking are still valid and in fact both are not yet superseded by any treaty. However I wonder if HM Government could still conclude any treaty with Republic of China, the successor of the Manchurian dynasty, because the British has turned to recogise the People’s Republic of China as the official regime of China. So, could the British still claim back Kowloon Peninsular and Island of Hong Kong? In their mind, PRC successed ROC in 1949.

    Kan Naoto sure knows what he’s doing, alright. Let’s just hope his DPJ don’t screw up and get themselves thrown out of power too soon.

    They just got hammered badly in the Upper House election last month since Kan proposed to raise taxes, which Japanese voters replied “Screw you!"

    Luckily for the DPJ, they still got a massive majority in the Lower House thanks to last year’s landslide win, but without control of the Upper House, it would mean they’ll need to tread carefully when passing legislation and not piss off anymore “allies" who hate their enemy the LDP (except the Budget, which doesn’t require the Upper House approval).

    The next Lower House election won’t be later than 2013, so if Kan (or whoever it is, Japanese PMs don’t seem to last long) gets this right, he’ll buy himself enough time to reverse all the damage Koizumi Junichiro has done and maybe go even further than PM Murayama’s apology in 1995, as well as giving a major slap in the face to all those right-wing scum.
