Tier 5 – Youth Mobility計劃的玄機

我看到這份文件時,由英國對Tier 5 – Youth Mobility嚴謹的態度,看到英國似乎已經開始對BOC, BOTC和BN(O)這三個,有不少機會被統合掉的國籍等級,作出相當寬鬆的過渡性安排。

Tier 5 – Youth Mobility是取代Working Holiday Scheme,本來是所有British Commwealth成員都有資格參與,但現時只剩下本來與英國關係密切的澳洲、紐西蘭和加拿大有得保留,加上統合掉日本和英國之間的交換計劃,令日本公民可以參與Tier 5行列。而澳洲、紐西蘭、加拿大和日本公民,都要18-30歲,有一千六百英鎊在銀行,以及得到當地政府的擔保書。

但BOC, BOTC和BN(O)很神奇,不用擔保書直取30分,同樣18-30歲,以及有一千六百英鎊在銀行便成,換言之,香港30歲以下的BN(O)持有人,肯儲一點錢就可以留英工作兩年。英國對BPP和BS沒有這優待(同樣英國國籍),而BOC, BOTC和BN(O)異常鬆代表什麼?

BOTC基本上絕大部分都不用Tier 5,因為BOTA下他們是英國公民,剩下要這樣去英國的BOTC極少,這批人可能最後都一併得到BC,因為BOTA的方法明顯有不切實際之嫌,所以英國可以放水。而BOC without holding other nationalities,或BOC in Hong Kong都已是BC,餘下的BOC最後都可能是Entry Clearance未用完,已經成為BC,所以可以出奇地鬆。剩下,便是BN(O),如果英國給予香港特殊優惠,HKSAR Passport持有人都可以,新加坡都可以,但新加坡和香港特區都沒有優待(政經條件相若),那剩下來的原因,比較合理的解釋,那是BN(O)亦會被平權,所以,英國可以在Tier 5中特別放水。

信不信也好,如果你剛畢業,又有大約千六英鎊的閒錢,我會建議申請Tier 5,總好過悶在香港。

    But I think you do need more than 1600 pounds. Don’t think they promise a vacancy is ready for you right after you hit Heathrow…

    Rent for a small room, plus the fee required before you found a job… you’ll need more than that.

    Otherwise, it’s good news for us… just like Joe Chung said a while ago.

    好睇份full Bill幾時可以實施。

    但依家Tier 5 – Youth Mobility鬆到離譜的態度,給人一種很明顯過渡性措施感覺,因為照現時英鎊低到離奇的匯率,HKD 25000左右儲蓄(唔計機票),已經可以考慮去英國,當提升英文,同換回英國投票權都好。

    In the old working holidaymaker programme, BOTC, BOC and BNO are eligible.

    BS and BPP holders are not eligible because ALL BSes and BPPs can apply for BC already. However, there are some BOTC, BOC and the majority of BNO are NOT eligible for full UK citizenship. So they need such a program.

    Note that many BOCs are from Malaysia or East Africa, which are developing countries.

    你看不到我推算重點,重點在於英國本來是大大收緊Tier 5 – Youth Mobility Scheme的申請要求,因為就算加拿大、澳洲、紐西蘭和日本,都要當地政府擔保才可以拎到30 marks,但BN(O), BOC和BOTC是不用英國政府擔保。

    除了放水,沒有其他解釋。

    我都覺得呢個Tier 5 – Youth Mobility真係鬆到離譜,最保守黎講,令我覺得bno真係被視英政府視為英國國民既一種,最起碼英國政府自己負責番擔保書果part,
    而唔係以前HO班膠人話bno唔係british passort,話bno holder係chinese national,有咩事唔該番去搵hksar 政府果種膠態度

    呢件事既重點好簡單,就係BOC,BOTC同BNO唔駛任何擔保直拎30分,咁點都算似番對本國國民待遇先啦,雖然只係一小部分,其他國家申請者全部要本國政府擔保呀

    如果係用番晒HO以前果套膠思維既,英政府實要求BNO holder有hksar政府既擔保先有得申請啦

    One good thing is NO quota system is applicable to BNO, BOTC and BOC. It seems that UK is willing to accept all BNO, BOC and BOTC who meets the requirements (age 18-30, with £1600). It is really not difficult to achieve.

    If the UK really wanted to close the door, why don’t it set up a quota for us?

    54. There will be annual allocations of places on the
    Youth Mobility Scheme for each of the individual
    participating countries. Youth Mobility Scheme entry clearance applications from nationals of a country listed in Annex A will be accepted for consideration only up to the point that their country’s annual Youth Mobility Scheme allocation for that year has been filled. All Youth Mobility Scheme entry clearance applications from British Overseas Citizens, British Overseas Territories Citizens and British Nationals
    (Overseas) will be accepted for consideration.

    你明我鬆到離譜的意思,現時英國的政策方向,由Tier 5具體實施方式看得很清楚,就係現階段開始逐步放水,在IA 1971和BNA 1981仍然生效的前提下放水,直至平權完成,但與此同時,其他國家國民基本上很難進入英國。

    你給那份Statement of Intent最過癮的地方是,完全沒解釋為何BOTC, BN(O)和BOC可以不受配額限制,以及免國家擔保。

    如此寬鬆是IA 1971通過以來未試過。(理論上,如果在英國搵到工作,在當地讀碩士學位的負擔會鬆很多。)

    However, it is possible that some BN(O)s have lost their ROA in Hong Kong and they have HK RTL only, as discussed in BHK. (Even all HKSAR pp holders have ROA in HK, they are NOT eligible for the YMS scheme.) HKSAR Govt does not sponsor any YMS visa holders with BNO passport.

    Some BOCs come from developing countries like Malaysia or East Africa. However, no developing countries are currently accepted to YMS at all. Some BOCs still do not have the right of abode of any country (not all BOCs eligible for BCs).

    It seems that the UK will “bear the wok" if any YMS (with BOC, BNO and BOTC) participant overstay or misbehave in the UK. So the conclusion by Martin Oei should be logical and reasonable. I cannot find any other better explanations.

    Martin的觀察我是十分同意的, 我們不妨再比較一下Tier 2 和Tier , BOTC的分別。BOTC人已不用Tier 2 Sponsor申請, 已可在英國工作. 佢哋根本已等同EEA/BC, 咁點解硬要group埋BOC/BOTC/BNO係Tier 5呢, 有點奇怪. (不要忘記以上British nationality, 均有"Overseas"標記!)

    對土木工程、測量等學生,特別剛拿了執業資格的年青人,這計劃他們願意一試,因為澳門和香港看來那些工程項目,養到自己都不錯。但英國至少有倫敦奧運這個大project,大家都知在官商勾結的香港,政府的工程只是好看不好吃。

    所以我說這明顯是合符IA 1971和BNA 1981前提下的過渡性安排。現階段英國先透過Tier 5放年青人進來,合符英國利益。

    What World Traveler Plus suggested is in fact deceiving the British Govt. What will the Brits think/feel if they see his post? His suggestion is actually jeopardising the citizenship prospect of 3.44 million BNO holders. WTP, if you really need to discuss the potential loophole in a bona fide manner, please go to a safe place.

    If a few BN(O) passport holders do things like this, the UK may re-close its doors. Think about the consequences before making suggestions. If BN(O)s borrow the money and stay in the UK, it is likely that they will overstay there because of financial insufficiencies. In serious cases, we will go back to the era that BN(O)s need a visa to visit the UK, EU and other developed countries. (Before 1997, HK-BDTC needed visa to enter the UK. I don’t want to see that again). Do you want our BN(O) pp as convenient as the mainland Chinese pp? Do you want to exacerbate the racial discrimination against us in the UK?

    However, if the UK re-closes the door, it will be unfair to BN(O) holders who are honest and capable.

    Please DO NOT use the mainland Chinese way to do things in the UK. (May be the way WTP suggested is common in mainland China). May be the UK is testing whether HK ppl is trustworthy or not.

    I think HK ppl(with university educated) is very smart on how to fulfill this requirement (similar to grant-loan requirement). Tier 5 applicant could borrow money from friend/family/bank to make them have HKD18400 (or more) for 1 to 2 months.

    UK government require the applicant of Tier 5 hold GBP 1600, and they will check the bank statement as evidence of asset. However, they don’t require applicant to provide the source of their asset. That’s mean if one applicant, whatever he hold BNO or Japanese, Australian passport, he/she can borrow GBP 1600 from family or friends, to fulfill the requirement without obey the regulation of Tier 5 scheme.

    How can you justify that, if a applicant of Tier 5 borrows money to fulfill the requirement of application, he/she will overstay in UK because of financial problem ?

    On the other hand, can you ensure any applicants of Tier 5 which can support themselves financially when they apply for Tier 5, must not overstay in UK because of financial problem or other reason ?

    Please prove evidence before you make such assumption. Thanks.

    It seems that we have discovered a major loophole in the Youth Mobility Scheme. And the loophole is quite dangerous.

    Those who do not have sufficient money can borrow money can borrow money from friends/relatives and enter the UK. Most BN(O)s are trustworthy, reliable and civilised and I believe that they will not use this loophole to cheat the UK Govt. However, there may be a black sheep (or even CCP spies). Don’t forget that Jo**son ***, garbi****, d*** are BNO holders and they may use this loophole to ruin the BNO movement. Don’t forget the Iceland incident.

    Too many mainland Chinese are using this way to cheat foreign consuls. So it is very difficult for them to get any visas.

    If they need to borrow money to enter the YMS, they are dishonest already. As citizen of the UK, why should we cheat the HM Government?

    If you want to go to the YMS programme, work hard and earn the money.

    Just like if you cheat in an examination does not mean that you genuinely know the stuff.

  20. Chrisie: 香港和英國沒有簽署工作假期的安排,所以只有持BN(O)的香港永久居民才合資格。
