呢份喺2009年11月12日發出嘅法案草案初稿，認真粗略，而且都寫得頗亂，要消化絕對係要相當時間，不過，小弟依家睇Immigration Bill 2009，有啲地方係可堪再三推敲。

A. 定義遊戲

根據草案嘅339條，UK Passport係咁定義：

「“United Kingdom passport” means a passport issued by—
(a) the Government of the United Kingdom,
(b) the Lieutenant-Governor of any of the Islands, or
(c) the Government of any territory whiBritish overseas territory. 」

BN(O)喺新嘅Immigration Bill下肯定係UK passport持有人，仲有以下兩樣嘢：

「“national” includes citizen;
“nationality” includes citizenship; 」

咁玩法背後有乜微言大義，小弟又係要再三推敲，但可以肯定，British nationality includes British citizenship，如果照Section 339咁解，絕對又可以玩餐死。

B. EEA公民定義

英國好明顯睇到BN(O)變成歐盟公民是勢不可擋，所以喺EEA居民定義果度出古惑，而且係勁古惑果隻

「3 EEA entrants
(1) For the purposes of this Act, “EEA entrant” means a person in relation to whom
condition A or B is met.
(2) Condition A is met if the person—
(a) is not a national of the United Kingdom,
(b) is a national of another EEA state or a national of Switzerland, and
(c) is entitled to enter and stay in the United Kingdom by virtue of any
provision made under section 2(2) of the European Communities Act
1972 (“the 1972 Act”).
(3) Condition B is met if the person—
(a) is not a national of an EEA state or of Switzerland, and
(b) by virtue of the person’s relationship with a national of an EEA state or
of Switzerland, is entitled to enter and stay in the United Kingdom by
virtue of any provision made under section 2(2) of the 1972 Act.
(4) For the purposes of subsections (2) and (3), a person is a national of the United
Kingdom if the person falls to be treated as a national of the United Kingdom
for the purposes of the Community Treaties. 」

a. Condition A一開始就講明不能是national of the United Kingdom，即係不能係聯合王國國民。
b. 喺subsection (4)果度，當一個人係被當成歐盟條約用途嘅英國國民時，就當你係EEA National嚟處理。

呢個做法，真係狗到唔恨，如果BNO唔打官司打爆歐盟公民定義問題，英國政府可以唔找數，由得歐洲其他國家吸納BNO持有人，但如果真係有人打官司，英國政府並且輸埋官司，都唔需要立即俾番BNO英國公民身份，用Immigration Bill 2009 Section 3嘅技術性條款，一炮過解決直布羅陀BOTC，有RoA嘅British Subject果堆問題，唔需要修改英國國籍法，甚至即俾BNO居英權又得，用A National of the United Kingdom for the purposes of the Community Treaties就得，進可攻退可守，狗到無朋友。

C. ECHR兼容性

如果要打官司，呢部分務必仔細研究，發掘到漏洞唔好講到咁揚，可以通過後立即告英國政府玩謝佢。或者喺議會審議階段果陣講出嚟，又得。
